1.0 Practice Notes

a. Stage Completion
The draft Stage Completion Certificate is still with LAM to revise the Guidelines. Mr Chee Soo Teng reported that pending LAM making a decision whether architects want a confirmation from PBT on the Letter of Acceptance of registration/submission of Form E, Ms Tan Pei Ing had made recommendation to LAM that architect should not be required to get Letter of Acceptance from PBT. Meanwhile, members were advised to follow the previous Guidelines.

Architect Chong Kum Kwan & Associates had sent reply to PAM instructing not to issue any plans or answer any queries requested by Ooi Say Kow because they had hand over the case to their solicitor - M/s Thayalan & Associates (Advocates & Solicitors). Ooi Say Kow may refer directly to their company for any queries so they can seek advice from their solicitor.

He was invited by a Receiver and Manager Consultant to participate in an abandoned project which has a design architect and separate submitting architect. He queried, whether he can take the task of new architect for the project without the discharge of the existing submitting architect?






No. Please refer to the LAM Guidelines on the Letter of Release.

He is concerned about fire rating and sound proofing features of the current construction of party walls for 2 storey link house.
Questions:

1. What building codes/laws governs the use of cement sand bricks as party walls and the method of construction?

2. Who is monitoring the method of construction and to ensure that every cement sand brick laid is fire rated?

3. The S&P unfortunately does not state the type of bricks use or the thickness of walls that the developer need to deliver - hence, are buyers getting short change?

3. The second Schedule requires the Approval Building Plan to be attached. Buyers should not sign the S&P if they are not happy with the Agreement.

Need opinion/advise on:

1. When the architect had taken more than 30 days to issue certificate for his work done without assigned any reason, what he can do?

2. When the consultant QS had requested Architect to issue instruction for QS to carry out the evaluation of his direct cost and expense for more than 21 days and the architect has not reply nor issue such instruction without assign any reason, what he can do?

3. If he will commence or file a complaint against this architect, what are the procedures involve?

1. Assume that period of interim certificates in clause 30 is 30 days, the Architect is on breach of his duty under the contract.

2. Apply for arbitration under clause 34 for withholding certificate.

3. Write to LAM who is the Statutory body governing the practice of Architects.

Appointed H.J. Chua & Associates as an Architect to erect a 3 storey bungalow house on Lot P.T. 1072, Jln Balau, Bukit Damansara, Kuala Lumpur. They complaint that the Architect and the Contractor had failed to execute their duties sufficiently and diligently which caused the non-completion of the premise on time. They wanted PAM to investigate whether the Architect has breached the Architect Rules 1996 or any other statutory provisions as alleged?



PAM to write standard letter to H.J. Chua & Associates for comments and copy letter to the complainants.

In Aug 2001 they bought a bungalow at Jln Permatang Damar Laut, Penang. The house was certified on Aug 2003. But after they made payment to the developer and collected the key of the house, they found that the electrical wiring surrounding the house was not concealed. They also noted that tarring of the roads servicing the housing area was only carried out 4 months after the issuance of the Architect's said certificate. They believe that the Architect had issued the certificate not because the housing unit was completed and ready for handing over but to enable the developer to collect the progress payment as well as for developer to get away with not having to pay them late delivery charges. They ask PAM to assist whether the Architect is justified in issuing the said certificate in Aug 2003. Based on the facts provided, the Architect was not justified to issue the certificate and to assist you in this matter, we enclose herewith the LAM Guidelines for Certification for your reference
