PKNS was presented with the
buyers' lawyer's letter in which they claimed the houses
that were delivered to them were not in accordance to
the UBBL 1984.
Architect sought PAM's view on:
i) Method of measurement that they had used is an acceptable
standard in the absence of diagrammatic method of measurement
in the UBBL.

vertical measurement from the
nosing edge to the lowest
obstruction above

of PAM has confIrmed that they are in order.

Based on the photograph,
the roofing system appears to be a proprietary roofing
system with specialised accessories. The Committee suggests
you submit the photographs to the manufacturer concerned
and enquire whether the roof had been constructed according
to the manufacturer's specification. |

Bought a 2-storey terrace house from a turnkey builder
in Selangor. They requested from the turnkey builder
for a set of as-built drawings to check if everything
was built to the architectural, structural and M&E
drawings but was asked to check with the respective
architect & engineers whether they would consider
selling the drawings. Wanted to know whether this is
an acceptable and fair practice from the turnkey builder
and/or architect company? |
Yes, it is an acceptable and fair practice. The plans
can be purchased. Unless it is expressed ,in your S
& P Agreement that you are to be provided with the
drawings, you have to purchase the drawings from the
relevant company.

A process engineering company was awarded the construction
and management of a turnkey Pharmaceutical plant in
Penang. The company requested for PAM to recommend building
contractors to deal with all the civil engineering work;
and requested to provide them the PAM form of contract. |

Queried on the responsibility of the architect
- does the architect has the responsibility to ensure
that the existing conditions of the adjacent building
are preserved? Complaining against Perunding YTC whom
he claimed had designed and submitted drawings to DBKL
with new terrace house to butt immediately against his
house which he bought as an end-unit.

From the facts of your letter it would appear that this
is a matter between you and the developer whereby the
developer failed to deliver an end unit per the S &
P Agreement. We advise you to seek legal advice to redress
the situation.
